Conclusion of contract – deposit<\/span><\/span><\/h3>\n

<\/h3>\n

The accommodation contract is concluded by the acceptance of the contracting party’s order<\/span> by the proprietor.<\/span> <\/span>
<\/span><\/span><\/p>\n

The proprietor is<\/span> entitled to conclude the Accommodation Agreement on the condition<\/span> that the party pays a deposit.<\/span> <\/span>
<\/span><\/p>\n

<\/span>The contracting party is obliged<\/span> to pay the deposit by the specified date. The costs of the money transaction (e.g. transfer charges) shall be borne by the<\/span> contractor.<\/span>
<\/span><\/p>\n

The deposit is a partial payment on the agreed fee. <\/span>
<\/span><\/span><\/p>\n<\/p>\n

Start and end of accommodation<\/span><\/span><\/h3>\n

<\/h3>\n

The contractual partner shall have the right, unless the proprietor offers a different reference time, to<\/span>
to move into rented rooms from 16.00 on the agreed day.<\/span>
The rented rooms are<\/span>
to be vacated by the contracting party by 10.30 a.m. on the day of departure. The accommodation provider is entitled to charge for an additional day if<\/span>
the rented rooms are not vacated in due time.<\/span>
<\/span><\/p>\n

Cancellation of the accommodation contract – cancellation fees<\/span><\/span><\/h3>\n

Cancellation by the accommodation provider<\/span><\/span><\/h4>\n

<\/h4>\n

If the accommodation contract provides for a deposit and if the deposit was paid by the<\/span>
the contracting party within the stipulated period, the hotelier may withdraw from the contract without a<\/span>
resign from the accommodation contract.<\/span>
If the guest does not appear by 20.00 on the agreed day of arrival, there is no<\/span>
accommodation obligation, unless a later arrival time has been agreed.<\/span>
If the contracting party has made a down payment, on the other hand, the accomodiation shall remain available until<\/span>
12.00 noon of the day following the agreed day of arrival.<\/span>
No later than 3 months before the agreed date of arrival of the contracting party, the<\/span>
accommodation contract by the accommodation provider, for objectively justified reasons, unless<\/span>
unless otherwise agreed, may be terminated by unilateral declaration.<\/span><\/span><\/span><\/span><\/span><\/p>\n<\/p>\n

Withdrawal by the contracting party<\/span><\/span><\/span><\/span><\/h3>\n

<\/h3>\n

Up to 3 months before the agreed date of arrival of the guest at the latest, the<\/span>
accommodation contract without payment of a cancellation fee by unilateral declaration by the<\/span>
contractual partner to be dissolved. Outside this period, rescission is possible by unilateral<\/span>
declaration of the contracting party is possible only upon payment of the following cancellation fees:<\/span><\/span><\/span>
up to 1 month before the day of arrival 40% of the total arrangement price.<\/span><\/span>
up to 1 week before the day of arrival 70 % of the total arrangement price<\/span><\/span>
in the last week before the arrival date 90 % of the total arrangement price.<\/span><\/span><\/span>
<\/span><\/p>\n

Obstructions of the journey<\/span><\/span><\/span><\/span><\/h3>\n

<\/h3>\n

If the contract partner cannot appear at the accommodation establishment on the day of arrival because of<\/span>
due to unforeseeable extraordinary circumstances (e.g. closed roads etc.) all<\/span>
travel possibilities are impossible, the contracting party is not obliged to pay the agreed<\/span>
fee for the days of arrival.<\/span><\/span><\/span>
The obligation to pay for the booked stay is revived from the date of arrival,<\/span>
if the arrival becomes possible again within three days.<\/span><\/span><\/span>
<\/span><\/p>\n

Provision of a substitute accommodation<\/span><\/span><\/span><\/span><\/h3>\n

<\/h3>\n

The proprietor may provide the party or the guests with adequate substitute accommodation.<\/span>
(of the same quality) if this is reasonable for the contractual partner,<\/span>
especially if the deviation is minor and objectively justified.<\/span><\/span><\/span>
A factual justification is given, for example, if the room(s)<\/span>
has (have) become unusable, guests who have already been accommodated extend their stay, a<\/span>
overbooking exists or other important operational measures require this step.<\/span><\/span><\/span>
Any additional expenses for the substitute accommodation shall be borne by the accommodation provider.<\/span><\/span><\/span>
<\/span><\/p>\n

Termination of the accommodation contract – early termination<\/span><\/span><\/span><\/span><\/h3>\n

<\/h3>\n

If the accommodation contract was concluded for a definite period of time, it shall end upon expiry of time.<\/span><\/span><\/span>
If the party departs prematurely, the proprietor shall be entitled<\/span>
to charge the full amount agreed upon. The accommodation provider will deduct what it has saved as a result of the<\/span>
the non-utilization of his service offer or what he saves through other means.<\/span>
renting of the ordered rooms. A saving is only present if the<\/span>
accommodation facility at the time of non-utilization of the services ordered by the guest.<\/span>
is fully occupied at the time of the non-use of the accomodation ordered by the guest, and the<\/span>
contractual partner can be rented to additional guests. The burden of proof of the savings shall be borne by the<\/span>
contractor.<\/span><\/span><\/span><\/span><\/p>\n<\/p>\n

Place of fulfillment and jurisdiction<\/span><\/span><\/span><\/span><\/h3>\n

<\/h3>\n

Place of performance and place of payment is the registered office of the hotel<\/span><\/span><\/span>.
The exclusive place of jurisdiction is the registered office of the hotel<\/span><\/span><\/span>
