The costs of the money transaction (e.g. transfer charges) shall be borne by the<\/span> <span dir=\"ltr\" role=\"presentation\">contractor.<\/span> <br \/><\/span><\/p>\n<p><span id=\"page110R_mcid28\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">The deposit is a partial payment on the agreed fee. <\/span><span dir=\"ltr\" role=\"presentation\"><br \/><\/span><\/span><\/p>\n<\/p>\n<h3><span id=\"page110R_mcid28\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">Start and end of accommodation<\/span><\/span><\/h3>\n<h3> <\/h3>\n<p><span id=\"page110R_mcid28\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">The contractual partner shall have the right, unless the proprietor offers a different reference time, to<\/span> <br role=\"presentation\"><span dir=\"ltr\" role=\"presentation\">to move into rented rooms from 16.00 on the agreed day.<\/span><br role=\"presentation\"><span dir=\"ltr\" role=\"presentation\">The rented rooms are<\/span><br role=\"presentation\"><span dir=\"ltr\" role=\"presentation\">to be vacated by the contracting party by 10.30 a.m. on the day of departure. The accommodation provider is entitled to charge for an additional day if<\/span><br role=\"presentation\"><span dir=\"ltr\" role=\"presentation\">the rented rooms are not vacated in due time.<\/span><br role=\"presentation\"><\/span><\/p>\n<h3><span id=\"page110R_mcid28\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">Cancellation of the accommodation contract &#8211; cancellation fees<\/span><\/span><\/h3>\n<h3> <\/h3>\n<\/p>\n<h4><span id=\"page110R_mcid28\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">Cancellation by the accommodation provider<\/span><\/span><\/h4>\n<h4> <\/h4>\n<p><span id=\"page110R_mcid28\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">If the accommodation contract provides for a deposit and if the deposit was paid by the<\/span><br role=\"presentation\"><span dir=\"ltr\" role=\"presentation\">the contracting party within the stipulated period, the hotelier may withdraw from the contract without a<\/span><br role=\"presentation\"><span dir=\"ltr\" role=\"presentation\">resign from the accommodation contract.<\/span><br role=\"presentation\"><span dir=\"ltr\" role=\"presentation\">If the guest does not appear by 20.00 on the agreed day of arrival, there is no<\/span><br role=\"presentation\"><span dir=\"ltr\" role=\"presentation\">accommodation obligation, unless a later arrival time has been agreed.<\/span><br role=\"presentation\"><span dir=\"ltr\" role=\"presentation\">If the contracting party has made a down payment, on the other hand, the accomodiation shall remain available until<\/span><br role=\"presentation\"><span dir=\"ltr\" role=\"presentation\">12.00 noon of the day following the agreed day of arrival.<\/span><br role=\"presentation\"><span dir=\"ltr\" role=\"presentation\">No later than 3 months before the agreed date of arrival of the contracting party, the<\/span><br role=\"presentation\"><span dir=\"ltr\" role=\"presentation\">accommodation contract by the accommodation provider, for objectively justified reasons, unless<\/span><br role=\"presentation\"><span dir=\"ltr\" role=\"presentation\">unless otherwise agreed, may be terminated by unilateral declaration.<\/span><\/span><span id=\"page110R_mcid29\" class=\"markedContent\"><\/span><span id=\"page110R_mcid30\" class=\"markedContent\"><\/span><span id=\"page110R_mcid31\" class=\"markedContent\"><\/span><\/p>\n<\/p>\n<h3><span id=\"page1R_mcid0\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">Withdrawal by the contracting party<\/span><\/span><span id=\"page1R_mcid1\" class=\"markedContent\"><\/span><span id=\"page1R_mcid2\" class=\"markedContent\"><\/span><\/h3>\n<h3> <\/h3>\n<p><span id=\"page1R_mcid2\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">Up to 3 months before the agreed date of arrival of the guest at the latest, the<\/span><br role=\"presentation\"><span dir=\"ltr\" role=\"presentation\">accommodation contract without payment of a cancellation fee by unilateral declaration by the<\/span><br role=\"presentation\"><span dir=\"ltr\" role=\"presentation\">contractual partner to be dissolved. Outside this period, rescission is possible by unilateral<\/span><br role=\"presentation\"><span dir=\"ltr\" role=\"presentation\">declaration of the contracting party is possible only upon payment of the following cancellation fees:<\/span><\/span><span id=\"page1R_mcid3\" class=\"markedContent\"><\/span><span id=\"page1R_mcid4\" class=\"markedContent\"><br role=\"presentation\"><span dir=\"ltr\" role=\"presentation\">up to 1 month before the day of arrival 40% of the total arrangement price.<\/span><\/span><span id=\"page1R_mcid5\" class=\"markedContent\"><br role=\"presentation\"><span dir=\"ltr\" role=\"presentation\">up to 1 week before the day of arrival 70 % of the total arrangement price<\/span><\/span><span id=\"page1R_mcid6\" class=\"markedContent\"><br role=\"presentation\"><span dir=\"ltr\" role=\"presentation\">in the last week before the arrival date 90 % of the total arrangement price.<\/span><\/span><span id=\"page1R_mcid7\" class=\"markedContent\"><\/span><span id=\"page1R_mcid8\" class=\"markedContent\"><br role=\"presentation\"><\/span><\/p>\n<h3><span id=\"page1R_mcid8\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">Obstructions of the journey<\/span><\/span><span id=\"page1R_mcid9\" class=\"markedContent\"><\/span><span id=\"page1R_mcid10\" class=\"markedContent\"><\/span><\/h3>\n<h3> <\/h3>\n<p><span id=\"page1R_mcid10\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">If the contract partner cannot appear at the accommodation establishment on the day of arrival because of<\/span><br role=\"presentation\"><span dir=\"ltr\" role=\"presentation\">due to unforeseeable extraordinary circumstances (e.g. closed roads etc.) all<\/span><br role=\"presentation\"><span dir=\"ltr\" role=\"presentation\">travel possibilities are impossible, the contracting party is not obliged to pay the agreed<\/span><br role=\"presentation\"><span dir=\"ltr\" role=\"presentation\">fee for the days of arrival.<\/span><\/span><span id=\"page1R_mcid11\" class=\"markedContent\"><\/span><span id=\"page1R_mcid12\" class=\"markedContent\"><br role=\"presentation\"><span dir=\"ltr\" role=\"presentation\">The obligation to pay for the booked stay is revived from the date of arrival,<\/span><br role=\"presentation\"><span dir=\"ltr\" role=\"presentation\">if the arrival becomes possible again within three days.<\/span><\/span><span id=\"page1R_mcid13\" class=\"markedContent\"><\/span><span id=\"page1R_mcid14\" class=\"markedContent\"><br role=\"presentation\"><\/span><\/p>\n<h3><span id=\"page1R_mcid14\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">Provision of a substitute accommodation<\/span><\/span><span id=\"page1R_mcid15\" class=\"markedContent\"><\/span><span id=\"page1R_mcid16\" class=\"markedContent\"><\/span><\/h3>\n<h3> <\/h3>\n<p><span id=\"page1R_mcid16\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">The proprietor may provide the party or the guests with adequate substitute accommodation.<\/span><br role=\"presentation\"><span dir=\"ltr\" role=\"presentation\">(of the same quality) if this is reasonable for the contractual partner,<\/span><br role=\"presentation\"><span dir=\"ltr\" role=\"presentation\">especially if the deviation is minor and objectively justified.<\/span><\/span><span id=\"page1R_mcid17\" class=\"markedContent\"><\/span><span id=\"page1R_mcid18\" class=\"markedContent\"><br role=\"presentation\"><span dir=\"ltr\" role=\"presentation\">A factual justification is given, for example, if the room(s)<\/span><br role=\"presentation\"><span dir=\"ltr\" role=\"presentation\">has (have) become unusable, guests who have already been accommodated extend their stay, a<\/span><br role=\"presentation\"><span dir=\"ltr\" role=\"presentation\">overbooking exists or other important operational measures require this step.<\/span><\/span><span id=\"page1R_mcid19\" class=\"markedContent\"><\/span><span id=\"page1R_mcid20\" class=\"markedContent\"><br role=\"presentation\"><span dir=\"ltr\" role=\"presentation\">Any additional expenses for the substitute accommodation shall be borne by the accommodation provider.<\/span><\/span><span id=\"page1R_mcid21\" class=\"markedContent\"><\/span><span id=\"page1R_mcid22\" class=\"markedContent\"><br role=\"presentation\"><\/span><\/p>\n<h3><span id=\"page1R_mcid22\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">Termination of the accommodation contract &#8211; early termination<\/span><\/span><span id=\"page1R_mcid23\" class=\"markedContent\"><\/span><span id=\"page1R_mcid24\" class=\"markedContent\"><\/span><\/h3>\n<h3> <\/h3>\n<p><span id=\"page1R_mcid24\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">If the accommodation contract was concluded for a definite period of time, it shall end upon expiry of time.<\/span><\/span><span id=\"page1R_mcid25\" class=\"markedContent\"><\/span><span id=\"page1R_mcid26\" class=\"markedContent\"><br role=\"presentation\"><span dir=\"ltr\" role=\"presentation\">If the party departs prematurely, the proprietor shall be entitled<\/span><br role=\"presentation\"><span dir=\"ltr\" role=\"presentation\">to charge the full amount agreed upon. The accommodation provider will deduct what it has saved as a result of the<\/span><br role=\"presentation\"><span dir=\"ltr\" role=\"presentation\">the non-utilization of his service offer or what he saves through other means.<\/span><br role=\"presentation\"><span dir=\"ltr\" role=\"presentation\">renting of the ordered rooms. A saving is only present if the<\/span><br role=\"presentation\"><span dir=\"ltr\" role=\"presentation\">accommodation facility at the time of non-utilization of the services ordered by the guest.<\/span><br role=\"presentation\"><span dir=\"ltr\" role=\"presentation\">is fully occupied at the time of the non-use of the accomodation ordered by the guest, and the<\/span><br role=\"presentation\"><span dir=\"ltr\" role=\"presentation\">contractual partner can be rented to additional guests. The burden of proof of the savings shall be borne by the<\/span><br role=\"presentation\"><span dir=\"ltr\" role=\"presentation\">contractor.<\/span><\/span><span id=\"page1R_mcid27\" class=\"markedContent\"><\/span><span id=\"page1R_mcid28\" class=\"markedContent\"><\/span><\/p>\n<\/p>\n<h3><span id=\"page3R_mcid0\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">Place of fulfillment and jurisdiction<\/span><\/span><span id=\"page3R_mcid1\" class=\"markedContent\"><\/span><span id=\"page3R_mcid2\" class=\"markedContent\"><\/span><\/h3>\n<h3> <\/h3>\n<p><span id=\"page3R_mcid2\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">Place of performance and place of payment is the registered office of the hotel<\/span><\/span><span id=\"page3R_mcid3\" class=\"markedContent\"><\/span><span id=\"page3R_mcid4\" class=\"markedContent\">. <br role=\"presentation\"><span dir=\"ltr\" role=\"presentation\">The exclusive place of jurisdiction is the registered office of the hotel<\/span><\/span><span id=\"page3R_mcid5\" class=\"markedContent\"><\/span><span id=\"page3R_mcid6\" class=\"markedContent\"><br role=\"presentation\"> <span dir=\"ltr\" role=\"presentation\">Swiss law applies<\/span><\/span><\/p>\n\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<\/div>\n\t\t","protected":false},"excerpt":{"rendered":"<p>Terms and Conditions Hotel Chasa Nova &#8211; Samnaun Conclusion of contract &#8211; deposit The accommodation contract is concluded by the acceptance of the contracting party&#8217;s order by the proprietor.
